SUMMARY OF MAIN PROVISIONS OF DRAFT SCHEME (NOT PART OF THE DRAFT SCHEME)
This draft Scheme provides for the transfer of the parish of Bentley and the parish of Tattingstone in the benefice of Sproughton with Burstall, Copdock with Washbrook and Belstead and Bentley with Tattingstone to the benefice of East Bergholt and Brantham where they shall continue distinct, together with the naming of the latter benefice’s incumbent and for the consequential amendment of benefice names and patronage for both benefices, together with the consequential and other amendments to the Samford Group Ministry all in the diocese of Saint Edmundsbury and Ipswich.
DRAFT
PASTORAL SCHEME
This Scheme is made by the Church Commissioners (“the Commissioners”) this day of 20 in pursuance of the Mission and Pastoral Measure 2011, the Right Reverend Joanne, Bishop of Saint Edmundsbury and Ipswich, having consented thereto.
WHEREAS
1. by virtue of a Scheme made by the Commissioners in pursuance of the Pastoral Measure 1983 (“the 1983 Measure”) on the 14th day of September 2000 (“the 2000 Scheme”) it was provided, amongst other things, that a new benefice of East Bergholt and Brantham and a new benefice of Sproughton with Burstall, Copdock with Washbrook and Belstead and Bentley with Tattingstone be created in the diocese of Saint Edmundsbury, and the said Scheme also established a group ministry (known as "The Samford Group Ministry") for the benefice of Capel Saint Mary with Little Wenham and Great Wenham, the benefice of Chelmondiston and Erwarton with Harkstead, the new benefice of East Bergholt and Brantham, the new benefice of Holbrook, Stutton, Freston, Woolverstone and Wherstead, the benefice of Shotley and the new benefice of Sproughton with Burstall, Copdock with Washbrook and Belstead and Bentley with Tattingstone in the diocese of Saint Edmundsbury and Ipswich;
2. by virtue of a further Scheme made by the Commissioners on the 31st day of March 2008 (“the 2008 Scheme”) in pursuance of the 1983 Measure, the benefice of Shotley and the benefice of Chelmondiston and Erwarton with Harkstead were united to create the new benefice of “Shotley with Chelmondiston, Erwarton and Harkstead” (the name of which was subsequently altered that same year to “The Shoreline benefice” (the 2008 Order”)) – but the latter bit was not reflected in relation to the benefices that then made up the Samford Group Ministry;
3. by virtue of an Order made by the then Bishop of Saint Edmundsbury and Ipswich on 25th day of June 2009 (“the 2009 Order”) in pursuance of the 1983 Measure, the name of benefice of Holbrook, Stutton, Freston, Woolverstone and Wherstead was altered to “The Two Rivers Benefice”;
4. the said Bishop has approved proposals for, amongst other things, transferring two parishes from one benefice to another, and altering certain names of the benefices in the Samford Group Ministry;
NOW, THEREFORE, it is hereby provided as follows:-
Transfer of parishes and alteration of benefice names
1. The parish of Bentley and the parish of Tattingstone, being two of the constituent parishes of the benefice of Sproughton with Burstall, Copdock with Washbrook and Belstead and Bentley with Tattingstone (the name of which shall be altered to "The Benefice of North Samford") in the diocese of Saint Edmundsbury and Ipswich, shall be transferred to the benefice of East Bergholt and Brantham (the name of which shall be altered to "The Constable Country Benefice") in the same diocese and shall continue distinct as two of the parishes which comprise the area of that benefice.
Designation of Incumbent
2. If immediately before this Scheme comes into operation the Reverend Christopher David Willis (“Mr Willis”) holds an ecclesiastical office in the benefice of East Bergholt and Brantham he shall be the incumbent of the benefice renamed the Constable Country Benefice pursuant to clause 1 hereof.
Amendment of patronage board 3.. The Second Schedule to the 2000 Scheme shall be deleted and the following shall be substituted:
“SECOND SCHEDULE TO THE SCHEME
Constitution of the Patronage Board for the renamed benefice of North Samford
The patronage board referred to in clause 6 (5) of this Scheme shall consist of:
(1) the Bishop of Saint Edmundsbury and Ipswich in her corporate capacity who shall be chair of the board and shall have two votes as a member of the board and a casting vote as chair;
(2) Saint Edmundsbury and Ipswich Diocesan Board of Patronage, which shall have two votes;
(3) the corporate body established for the Cathedral and Metropolitical Church of Christ Canterbury, which shall have one vote.”.
Transfer of patronage 4. With the consent of the Master, Fellows and Scholars of Emmanuel College in the University of Cambridge (“Emmanuel College, Cambridge”); and the Bishop of Saint Edmundsbury and Ipswich in her corporate capacity (“the Bishop of Saint Edmundsbury and Ipswich”) (which consents have been given in writing), a share of the patronage of the benefice of East Bergholt and Brantham, which patronage is now vested in Emmanuel
College, Cambridge, shall hereby be transferred to and vested in the Bishop of Saint Edmundsbury and Ipswich to the end that the right of presentation to the benefice renamed The Constable Country Benefice pursuant to clause 1 hereof shall henceforth be exercisable jointly by Emmanuel College, Cambridge; and the Bishop of Saint Edmundsbury and Ipswich.
Amendments to the Samford Group Ministry 5. (1) The Samford Group Ministry shall be amended so that in clause 7(1) of the 2000 Scheme for the words “the new benefice of East Bergholt and Brantham” and “the benefice of Sproughton with Burstall, Copdock with Washbrook and Belstead with Bentley and Tattingstone” there shall be substituted the words “the Constable County Benefice” and “the benefice of North Samford” respectively, and for the words “the benefice of Shotley with Chelmondiston, Erwarton and Harkstead” as a result of the 2008 Scheme there shall be substituted the words “the Shoreline benefice” to reflect the alteration of name brought about by the 2008 Order; and for the words “the new benefice of Holbrook, Stutton, Freston, Woolverstone and Wherstead” there shall be substituted the words “The Two Rivers Benefice” to reflect the alteration of name brought about by the 2009 Order.
(2) If pursuant to clause 2 hereof Mr Willis becomes the incumbent of the benefice renamed the Constable Country Benefice, he shall hold that benefice as a benefice in the Samford Group Ministry.
Coming into operation of this Scheme
6 This Scheme shall come into operation upon the first day of the month following the date of it being made by the Commissioners.

The Commissioners have been told by the Bishop on the advice of her Diocesan Mission and Pastoral Committee that the rationale behind the diocesan proposals is as follows:
Following the resignations of the previous incumbents of both benefices ,the Samford deanery pastoral committee and synod have proposed the transfer of the parishes of Bentley; and Tattingstone to the neighbouring benefice. The purpose is to even out both parishes and clergy posts between the two benefices (the Sproughton with Burstall, Copdock with Washbrook and Belstead with Bentley with Tattingstone North Samford post is half-time benefice with a half-time diocesan role).
Publication of this draft Scheme by the Commissioners does not mean that we have taken a view on the merits of the diocesan case. We have a duty to publish draft Schemes based on diocesan proposals.
If we receive representations against the draft Scheme, we will send all representations, both for and against, to the Bishop whose views will be sought. Individual representors will then receive copies of our correspondence with the Bishop (including copies of all the representations) and they may comment further in writing to us in light of the diocesan response if they so wish.
If there are no representations against the draft Scheme, we will make the Scheme and arrange for it to be brought into effect.
Clause 1 – the benefice already known locally as North Samford The renaming of the benefice of Sproughton with Burstall, Copdock with Washbrook and Belstead and Bentley with Tattingstone to “North Samford” is to legally regularise its local name.
Clause 4 The amendment to the Second Schedule of the 2000 Scheme is to reduce the number of votes held by the Bishop of Saint Edmundsbury and Ipswich from three votes as a member of the board to two (together with retaining her casting vote as chair). The reduction is votes is made due to the transfer of parish of Bentley and the parish of Tattingstone from the benefice of Sproughton with Burstall, Copdock with Washbrook and Belstead and Bentley with Tattingstone (as renamed “North Samford”) to the renamed and enlarged benefice of East Bergholt and Brantham.
Clause 5 The amendments to the Samford Group Ministry stablished by the 2000 Scheme is to reflect the alterations of benefice names which this Scheme provides for, and to address that which the 2008 Order and the 2009 Order had overlooked.
